Standard Terms & Conditions
Eligibility:
This program is open to enrolled Keller Graduate School of Management or DeVry University students who are currently attending class or alumni
(graduates or former students with a D#) ("Participants"). Participants must be at least 18 years of age and reside in the United States or in Canada.
Participants that start in the same session as the Successful Referral are not eligible for a Referral Award. Employees of Sponsor and its respective
parent companies, affiliates, subsidiaries, retailers, sales representatives, distributors, advertising/promotion agencies and the immediate families
and household members of each are not eligible to enter this program. All referring participants are required to certify that they are not employees.
How the Program Works:
A Participant enters the program by submitting all required information at www.kellerreferral.com. The
required information includes the name, address, and current, valid email address of the Participant and the Participant's referred friend/family
member ("Referral"). After the required information is submitted by the Participant, an email is sent to the Referral. An Award Package is sent to
the Participant's email address provided on the Website within 60 days after a Successful Referral is made. A Referral that results in a new student
enrollment at either DeVry University or Keller Graduate School of Management, whereby the new student starts class and remains enrolled for at least
two weeks and makes all required tuition payments, is defined as a Successful Referral. All referral information will be kept for 24 months or until
the Referral either accepts or declines to enroll. (Note: If the email address of the Participant or Referral changes before it becomes a Successful
Referral, that Participant is disqualified from the program for that Referral.)
Referral Awards:
For each Successful Referral, an Award Package will be sent to the Participant's email address provided on the Website. The Award Package includes
directions on where to find Participant's award options. The Participant is required to submit additional information, including either their federal
tax ID, Social Security Number, or Social Insurance Number to claim the Referral Award. No matter the number of Successful Referrals made by the
Participant, the participant is limited to receiving only one Referral Award in any 12-month period. Each Referral Award is limited to a maximum value
of $100 and cannot be combined with any other offer or award. Referral Awards are non-transferable and are not subject to cash redemption or
substitutions except as provided in the following sentence. In the event of unavailability of any Referral Award, Sponsor reserves the right to
substitute an award of equal value. All taxes on Referral Awards are the sole responsibility of the Participant.
General:
This version of the program is effective July 1, 2010. Referrals made before that date, and between November 1, 2008 and December 31, 2008 are only
eligible for Referral Awards under the terms and conditions of the previous program. This program is intended for participation within the United
States and Canada only and shall be construed and evaluated according to the laws of the United States. Do not participate in this program if you do
not reside in the United States or Canada. Sponsor reserves the right to alter, amend, or cancel any part of or the entire program at any time without notice. Sponsor is not responsible for
lost, late, illegible, misdirected, mutilated, or incomplete entry information. Sponsor shall not be
responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with
or utilized in the program or by any technical or human error which may occur in the processing of this information. Sponsor is not responsible for
computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network
connections that are human or technical in nature. Entry information becomes the property of Sponsor and will not be returned. Should multiple users
make the same Referral, the user who first submitted the referral information will be deemed the Participant. Should multiple users of the same e-mail
account enter the program and a dispute thereafter arises regarding the identity of the Participant, the authorized subscriber or said e-mail account
at the time of submitting the referral information will be deemed the Participant. "Authorized account subscriber" is defined as the natural person
who is assigned an e-mail address by an internet access provider, online service provider or other organization which is responsible for assigning
e-mail addresses or the domain associated with the submitted e-mail address. Sponsor reserves the right at its sole discretion, to disqualify any
individual (and all of his or her Referrals) who tampers with the program. By participating in the program and/or accepting an award, Participant
agrees (and agree to confirm in writing): (a) to release Sponsor, its parent companies, affiliates, subsidiaries, retailers, sales representatives,
distributors and each of their respective officers, directors, employees, shareholders and agents from any and all liability, loss or damage incurred
with respect to the awarding, receipt, possession and/or use or misuse of any award; (b) under no circumstances will Participant be permitted to
obtain awards for, and Participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual
out-of pocket expenses; (c) all causes of action arising out of or connected with this program or any award, shall be resolved individually, without
resort to any form of class action; and (d) any and all claims, judgments and award shall be limited to actual out-of-pocket costs incurred, excluding
attorney's fees and court cost. By participating in this program, Participant agrees to be bound by these Standard Terms and Conditions and all
decisions made by Sponsor made in all matters related to this program.
Choice of Law:
Participant agrees that all issues and questions concerning the construction, validity, interpretation and enforceability of these Standard Terms and Conditions, Participant's rights and obligation, the rights and obligations of the Sponsor and any and all claims arising out of or related to or in connection with the program shall be governed by and construed in accordance with the laws of the State of Illinois, without giving effect to any choice of law or conflict of law provisions (whether of the State of Illinois or any other Jurisdiction) which would cause the application of the laws of any jurisdiction other than the State of Illinois. Further, Participant consents to the jurisdiction and venue of the federal, state and local courts located in the State of Illinois.
